Terms

The deal, in plain words.

Short on purpose. If any of it seems unfair, say so before you sign up rather than after.

1. Who this is between

Trimsy is a trading name of TO CONFIRM: legal name, company number, registered office. "We" is us, "you" is the business subscribing.

2. What we do

We give you a booking system for your shop: a booking page on your own web address, a diary for your staff, an app for their phones, email confirmations and reminders for your customers, and somewhere to keep your customer list. If you do not have a website we build one and host it, included in the price.

We also move your customers over from whatever you were using, by hand, as long as you can export them from it. If your old provider will not give you your own list, that is between you and them, and it is worth knowing that under UK GDPR you have a right to it.

3. What it costs

  • £79 a month per shop, however many barbers you have.
  • No commission on any booking, ever.
  • Prices exclude VAT where it applies.
  • Paid monthly in advance by card, through Stripe.
  • We will give you 30 days' notice by email before the price changes, and you can cancel in that time.

4. The free trial

Fourteen days, with no card. The fortnight starts the day your shop goes live, not the day you sign up, because building your website takes longer than a fortnight and it would not be fair for our work to eat your trial. If you do not subscribe, nothing is charged and nothing is deleted straight away.

5. Stopping

Cancel any time, from the billing page or by emailing us. There is no notice period and no exit fee. You keep the service until the end of the month you have paid for, and we do not refund part months.

If a payment fails, we will tell you and the diary keeps working for seven more days before the staff side locks. Your booking page keeps working regardless, so your customers are never caught in the middle of a bill between us and you.

6. Your data is yours

Your customers, your bookings, your history and your photographs belong to you. We do not sell them, we do not market to your customers, and we do not use your list to sell to anyone else. If you leave, you can have the lot in a spreadsheet, and we delete our copy within 90 days of you asking.

7. Your side of it

  • Keep your PINs to yourself and cut off devices you no longer use.
  • Tell your customers what you do with their details. We give you the tools; the relationship is yours.
  • Do not use it for anything illegal, and do not try to break it.
  • Own the photographs and the logo you give us, or have permission to use them.

8. Your customers' data

When somebody books with you, you are the data controller and we are your processor. In plain terms that means we only do what you tell us to with their details, we keep them confidential, we protect them, we help you if a customer asks to see or delete what you hold, and we give them back or destroy them when you go. We use Stripe, Resend, Hostwinds and Namecheap to do it, and we will tell you before that list changes.

TO CONFIRM: this section is a plain English summary of what UK GDPR Article 28 requires. Have a solicitor turn it into the full clause before relying on it.

9. What we do not promise

We aim to keep the booking page up all the time and we will tell you honestly when we have not. We do not offer a guaranteed uptime figure or pay compensation for downtime, because we would rather promise nothing than promise a number we cannot keep. There is no overnight support line.

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit. Beyond that, our total liability to you in any twelve months is limited to what you paid us in those twelve months, and we are not liable for lost profits or lost business.

10. Ending it from our side

We can end this with 30 days' notice, or immediately if you do not pay, or if you use it for something illegal. If we close the service down entirely, you get at least 90 days' notice and your data in full.

11. The law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
